Terms of Service

These Terms of Service are the agreement between you and Tidbit for using the Tidbit app and ordering photobooks through it. By downloading the app, creating an account, or placing an order, you agree to these terms. If you do not agree, please do not use Tidbit. Questions? Email us at support@tidbitbooks.com.

Agreement to these terms

These terms, along with our Privacy Policy, govern your use of the Tidbit app and the books you order through it. If a separate written agreement between you and Tidbit ever conflicts with these terms, that agreement controls.

Who can use Tidbit

You must be at least 13 years old, and old enough to form a binding contract where you live, to use Tidbit. If you place an order, you confirm that the payment method is yours to use and that the shipping details you provide are accurate.

Your account

Some features require an account. You are responsible for keeping your login secure and for activity that happens under your account. Let us know right away if you think someone else has accessed it.

You can delete your account, and the data associated with it, from within the app or by emailing us.

Your photos and content

You keep full ownership of the photos, voice recordings, captions, and other content you bring to Tidbit. We do not claim ownership of it.

You must have the rights to everything you add to a book. By using Tidbit, you confirm that you own your content or have permission to use it, and that printing it for personal use does not violate anyone else's rights, including copyright, privacy, and publicity rights.

You grant Tidbit a limited license to use your content only as needed to operate the service: to design, preview, print, deliver, and support your book, and to keep the app working and secure. This license exists only so we can provide Tidbit to you, and it ends when your content is no longer needed for those purposes. We explain how we handle photos in detail in our Privacy Policy.

AI captions and stories

Tidbit uses AI to suggest captions, titles, layouts, and short stories to help you start. These are suggestions, not finished writing. They can contain mistakes or wording you would not choose.

You are responsible for reviewing and editing your book, including any AI-generated text, before you order it. Once you approve and place an order, the final content is yours. AI suggestions are not guaranteed to be unique, and similar suggestions may be offered to other users.

Ordering, pricing, and payment

Available sizes, options, and prices are shown in the app before you order. Prices can change, and taxes and shipping may be added at checkout. The price of a book can depend on details like its page count.

Placing an order is an offer to buy, which we accept when we begin producing your book. Payments are processed by our payment provider, Stripe. When you order, you authorize us and Stripe to charge your selected payment method for the total shown.

Production, changes, and cancellations

Every Tidbit book is custom made from the photos and content you choose, and printed just for you. Because production starts soon after you order, there is only a short window to change or cancel an order.

If you need to change or cancel, contact us as soon as possible and we will help if production has not started. Once production has begun, an order generally cannot be changed or canceled. Please see our Returns & Refunds policy for what happens next.

Shipping and delivery

We print and ship your book through our production and shipping partners. Production and delivery times shown in the app or on our site are estimates, not guarantees, and can vary by destination. Full details are in our Shipping Policy.

Returns, reprints, and our happiness guarantee

We want you to love your book. If it arrives damaged, misprinted, or not what you ordered, we will reprint it or refund you under our happiness guarantee. Because each book is personalized and made to order, we generally cannot accept returns for other reasons, such as a change of mind or photos or text you approved before ordering. Acceptable use

You agree to use Tidbit only for lawful, personal purposes, and not to create or order books that:

  • Contain content you do not have the rights to use.
  • Are unlawful, infringing, hateful, harassing, or that sexualize or exploit minors.
  • Violate someone's privacy or publicity rights, or are defamatory.
  • Are intended for resale or commercial redistribution without our permission.

You also agree not to misuse, copy, or interfere with the app, its security, or its underlying technology.

Our intellectual property

The Tidbit app, name, logo, designs, templates, and software belong to Tidbit and are protected by law. We grant you a limited, personal, non-transferable license to use the app to design and order books. We keep all rights not expressly granted to you.

Third-party services

Tidbit relies on trusted partners to operate, including our payment processor and our print and shipping partners. Your use of those services may also be subject to their terms, and we are not responsible for their separate acts or omissions beyond what the law requires of us.

Disclaimers

Tidbit is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties such as merchantability and fitness for a particular purpose. We do not guarantee that the app will always be uninterrupted, error free, or that printed colors will exactly match what you see on your screen, since screens and printing naturally differ.

Limitation of liability

To the fullest extent permitted by law, Tidbit will not be liable for indirect, incidental, special, or consequential damages, or for lost data or profits. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some places do not allow these limits, so parts of this section may not apply to you.

Indemnification

You agree to cover and hold Tidbit harmless from claims, losses, and costs that arise from content you provide or from your misuse of the app, to the extent permitted by law.

Suspension and termination

We may suspend or close an account that violates these terms or that we reasonably believe is being misused. You can stop using Tidbit at any time and delete your account. Sections that by their nature should survive, such as content rights you granted, disclaimers, and limits of liability, will continue to apply after your account ends.

Governing law and disputes

These terms are governed by the laws of the United States and the state in which Tidbit operates, without regard to its conflict-of-laws rules.

If you have a concern, please email us first so we can try to resolve it informally. We resolve most issues quickly that way. If we cannot, any dispute will be handled in the courts with proper jurisdiction where Tidbit operates, unless applicable law gives you the right to do otherwise.

Changes to these terms

We may update these terms as Tidbit grows or as laws change. When we do, we will revise the date at the top, and continued use of Tidbit after an update means you accept the revised terms.
